1. Who provides the service

The service described below is operated by:

Anton Čeremnych

Cesta brigádníků 819, 278 01, Kralupy nad Vltavou, Czechia

Company number: 04560540

These terms govern the use of the Packmetr service and form part of every contract concluded through it. By creating an account or placing a paid order you accept them in the version published on this page at that moment.

Anything to do with these terms, an order or a complaint goes to [email protected]. We answer within thirty days at the latest, and usually much sooner.

2. Definitions

Provider
The person or company named in section 1.
User
Anyone who uses the Service, with or without an Account.
Consumer
A User who is a natural person and is not acting within their trade, business or profession. Some clauses below apply to Consumers only, and say so.
Service
The Packmetr load planner and everything offered through it, in both its free and its paid form.
Account
The registered access a User creates with an email address and a password.
Plan
One saved load: the vehicle, the cargo lines and the layout they are arranged in.
Pro
The paid tier of the Service, which unlocks the features listed on the pricing cards.
Kiosk
The paid counter-screen product: one licensed location lets a shop run one self-service screen for customers to check parcels.
Licensed location
One place where Kiosk is used under one paid licence: either one active self-service screen at a single physical site — a shop, a branch or a pickup point — or one integration of Kiosk into a single website belonging to the User's own business. It is not a right to share the kiosk address publicly or without limit.
Subscription
A recurring paid entitlement to Pro or to Kiosk, for the billing period shown before payment.

3. The service, and how the contract is formed

Packmetr works out whether cargo fits in a vehicle. It is a planning aid: the figures it shows are calculated from the dimensions entered and from published catalog data, and they do not replace the operator's own check of the actual vehicle and the actual load.

The planner itself is free and needs no Account. An Account is only required to keep Plans on our servers, to share them and to buy a paid Subscription.

The contract for the Service is formed when an Account is created. At that point the following is confirmed, on its own checkbox, before the Account can be created:

I agree to the terms and conditions

A Subscription is a separate contract, formed when payment for the chosen billing period is successfully completed. Access to the paid product is granted immediately at that moment — which is what section 7 is about.

We keep the Service running with reasonable care but do not guarantee uninterrupted availability. Maintenance is carried out outside peak hours wherever it can be planned, and we may develop and change the Service over time. If a change materially reduces what a paid Subscription provides, we tell paying Users in advance and they may cancel with effect from the change.

4. Prices and payment

Current prices are shown on the pricing cards, for each billing period offered: Packmetr pricing

The price displayed at the moment of ordering is the price charged for that billing period. The billing currency follows the country the order is placed from; whether VAT is included or added is stated next to the price before payment. Business customers registered for VAT in another EU member state may be invoiced without Czech VAT under the reverse charge, provided a valid VAT identification number is given before payment.

Payment is taken by Stripe. Card details are entered on Stripe's own pages and never pass through the Service. A payment is treated as made when Stripe confirms it, and a receipt is issued for it.

If a recurring payment fails, Stripe retries it on its usual schedule and we show a warning in the account. The paid product remains available during those retries. If none of them succeeds, the affected Subscription is cancelled: Pro features stop, and Kiosk screens stop answering customers until a live Kiosk Subscription is in place again.

We may change the price of a Subscription. Paying Users are told by email at least thirty days before the new price applies, and it takes effect from the next billing period after that notice. Anyone who does not want to continue at the new price may cancel before it takes effect, as described in section 6.

Kiosk is billed per licensed location. The number of licensed locations can be changed from the account page; Stripe works out any adjustment for the rest of the current billing period and confirms it before the changed quantity takes effect in the Service.

A licensed location is designed for a set number of checks a minute, and its screen is held to that number: a check beyond it is refused until the next minute begins, and the customer is asked to try again in a moment. Opening the kiosk address counts as a check as well. The number of checks a minute one licensed location is designed for: 60.

That number is not raised for a location that needs more. More checks call for more licensed locations, each with its own address. Any other arrangement is possible only by individual agreement with us, made through the contact address in section 1.

5. Rights and obligations — access to the service

The Account and the password belong to the User, who keeps them secure and does not share them. Anything done through an Account is treated as done by the User who holds it. A User who suspects that someone else has gained access should tell us at the contact address above without undue delay, and we will help secure the Account.

An Account may not be created by anyone under sixteen.

When using the Service, the User must not:

  • break the law, or infringe anyone else's rights;
  • gain access to parts of the system that were not opened to them, or test its security without our written agreement;
  • collect data from it automatically, or load it beyond ordinary use;
  • resell access, make Pro features available to people outside the Account holder's own business, or use Kiosk outside the licensed locations. Customers using a Kiosk screen at a licensed location are allowed.

A kiosk address belongs to the licensed location it was issued for. It may be shown on the screen at that site or placed on that one website, but it may not be published openly (for example on social networks or in listings), handed to other businesses or branches, or used to serve several sites under one licence. Every further site or website needs its own licensed location.

The Service records how many checks each kiosk location answers. Where that count shows use clearly beyond what a single site normally generates, we may contact the User, ask how the address is being used and propose a number of licensed locations that matches the actual use. If the User does not accept that and the use continues, it is treated as a breach of these terms under this section.

Where any of this happens seriously or repeatedly, we may suspend the Account. We give notice and a chance to put it right first, unless the breach makes that impossible. A Subscription suspended through no fault of the User is extended by the time it was suspended.

Everything a User enters — Plans, cargo lines, vehicle data and route details — stays theirs. They grant us only the permission needed to store and process it in order to run the Service, and nothing beyond that. We do not use it to train anything, and we do not pass it on except as set out in the privacy notice.

The Service itself — the software, the interface, the drawings and the vehicle catalog — remains the Provider's. Using the Service does not transfer any of those rights, and none of it may be copied, decompiled or rebuilt into a competing product.

6. Automatic renewal and cancelling a subscription

A Subscription renews by itself at the end of each billing period, for another period of the same length, until it is cancelled. The price of the new period is taken automatically from the payment method on file.

It can be cancelled at any time from the account page, which opens the payment provider's own portal. No reason has to be given and no notice period applies. Cancelling stops the next renewal; the paid product stays available until the end of the period already paid for, and that period is not refunded pro rata. Section 7 and section 8 are unaffected by this.

No Plan is deleted when a Subscription ends, and no Plan is altered. The Account and every Plan in it stay in place and stay usable; only the paid products stop working. What is lost when Pro ends is the ability to save a further Plan while more are stored than the free tier allows — to save a new one, the User either renews Pro or deletes stored Plans until fewer are held than the limit. The number of Plans the free tier allows: 3.

Pro also allows the User to upload an account logo, for example for the loading sheet. If Pro ends or is switched off, the account logo file uploaded under Pro is permanently deleted and cannot be restored.

When a Kiosk Subscription ends, existing kiosk locations are not deleted. Their addresses, labels and history stay in the account, but the screens do not answer customers until the User renews Kiosk and switches on the locations they want to use.

Each paid Kiosk location may have its own logo. If the Kiosk Subscription ends, or if a particular kiosk location is switched off, the logo file for that kiosk is permanently deleted and cannot be restored.

We may end a Subscription ourselves, other than for a breach under section 5, by giving thirty days' notice by email and refunding the unused part of the period already paid for.

7. Withdrawal from the contract (digital content)

A Consumer buying at a distance normally has fourteen days to withdraw from the contract without giving a reason. A Subscription to this Service is different, because access to the paid product is granted the moment payment succeeds rather than at the end of that period.

Because of that, before each paid order is placed, the following is confirmed separately — on its own checkbox, which is not ticked in advance and which the order cannot be placed without:

I agree that the service starts immediately, and I acknowledge that I thereby lose my right to withdraw from the contract.

Confirming it is an express request for the service to begin before the withdrawal period has run, and an express statement by the Consumer that they have been informed the right to withdraw ends when it does.

This follows from § 1837 (l) of the Civil Code. Under it, the right to withdraw from a contract for digital content not supplied on a physical medium falls away once performance has begun — and for performance against payment, only where all three of the following hold: performance began with the Consumer's prior express consent given before the withdrawal period had run; the Consumer was informed that this extinguishes the right to withdraw; and we gave the Consumer a confirmation of the contract in text form recording both. We send that confirmation by email once the order is placed.

Where that confirmation is not given, the fourteen-day right applies in full and is unaffected by anything else in these terms. The period runs from the day the contract was concluded.

To withdraw where the right does apply, it is enough to tell us in any clear way — an email to the contact address in section 1 saying that you are withdrawing, with the order or the email address it was placed under. A form is not required, and we will confirm receipt. We refund everything paid within fourteen days of being told, using the same payment method, at no cost to you.

This section concerns the statutory right of withdrawal only. Cancelling a Subscription for the future is always possible under section 6, whether or not this right applies.

8. Rights arising from defective performance

We are obliged to provide the Service as it is described on this site and to keep it working for the whole of a paid period. A defect is a material failure of the Service to do that for a prolonged time — for example, a paid product not being available on a paid Account.

These are not defects:

  • a short interruption, or planned maintenance;
  • a fault in the User's own device, browser or connection;
  • a difference between the catalog's published vehicle figures, which are averages, and an individual vehicle;
  • a result the User disagrees with that follows from the dimensions and weights they entered.

Report a defect to the contact address in section 1 without undue delay, describing what happened and when. We acknowledge every complaint and decide it within thirty days of receiving it, unless a longer period is agreed with the person who raised it.

A Consumer may first require the defect to be remedied. If we do not remedy it within a reasonable time, or if remedy is impossible, they may ask for a proportionate reduction of the price or withdraw from the contract — and where they withdraw, we refund the part of the price covering the time the Service could not be used. The statutory rights of a Consumer are not limited by anything in this section.

9. Liability and its limits

Packmetr calculates from the dimensions and weights entered and from published vehicle figures, which are averages and can differ from an individual vehicle by roughly five to ten per cent. Deciding that a load is safe and lawful — its securing, its weight distribution and the limits on the registration document — remains with whoever loads and drives it. The Service gives no advice on road safety and issues no certification.

Because of that tolerance the Service marks a fit as a close one: when a box takes up 90% or more of the load space along any one side, the planner says so on screen. That warning means the result depends on figures accurate to a few centimetres at best, and the load should be measured against the actual vehicle before it is relied on. The absence of the warning is not a guarantee either — it only means no single box came that close.

We are liable for damage we cause by breaching these terms. We are not liable for loss of profit, loss of business, fines, delays or other indirect loss, nor for damage caused by figures being relied on without the check described above.

Except where the law does not permit it, our total liability arising out of the Service is limited to the amounts paid for it in the twelve months before the event that caused the damage.

Nothing here limits liability for damage caused intentionally or by gross negligence, for harm to a person's life or health, or any right a Consumer has that cannot be limited by agreement.

Neither side is liable for a failure caused by circumstances beyond its control — including outages at hosting, payment or mapping providers — for as long as those circumstances last.

10. Out-of-court dispute resolution

If a complaint cannot be settled between us, a Consumer may take it to the competent body for out-of-court resolution, which is free of charge for them:

Česká obchodní inspekce

For a purchase made from another EU country, the European Commission's online dispute resolution platform can be used as well: https://ec.europa.eu/consumers/odr

These terms and any contract under them are governed by Czech law, and the courts of the Czech Republic decide any dispute. For a Consumer resident in another EU member state, this does not remove the protection of the mandatory rules of the law of their own country, nor their right to bring proceedings there.

11. Personal data

What is collected, why, on what legal basis and for how long is set out in full in the privacy notice, which is part of the information provided with these terms: Privacy notice and GDPR

12. Final provisions

We may change these terms — because the Service changes, or because the law does. Registered Users are told by email at least thirty days before a change takes effect, and the date at the top of this page moves with it. Anyone who does not accept a change may cancel any Subscription before it applies; continuing to use the Service after that date means the new version applies.

A change never applies backwards. An order already placed, and the billing period it paid for, are governed by the version of these terms published when it was placed.

If any provision here turns out to be invalid or unenforceable, the rest stays in force and the invalid provision is replaced by the closest lawful one to what it intended.

These terms are issued in Czech, and the Czech version is the binding one. The English and Russian versions are provided for convenience; if they differ, the Czech text prevails. The contract is concluded in the language the User chose when concluding it, and is archived by us in electronic form. This page can be saved and printed in full at any time.

This version takes effect on August 18, 2026.
